Rancho Cucamonga Approves Single Cannabis Delivery Service in Compliance with State Law

In a recent decision marked by regulatory compromise, Rancho Cucamonga, a city in California, has agreed to permit just a single medical cannabis delivery service within its boundaries. This move, unanimously approved by the City Council, aligns with the state's Medicinal Cannabis Patients’ Right of Access Act, signed into law by Governor Gavin Newsom in September 2022. The Act, effective from January 1, 2024, mandates that cities allow at least one delivery service for medical marijuana to cater to medical patients.

The city's decision to authorize only one delivery service is a response to California's evolving cannabis laws. In 2017, Rancho Cucamonga had prohibited all commercial cannabis sales, though it permitted indoor cultivation for personal use following the 2016 passage of Proposition 64, the Adult Use of Marijuana Act. The recent ordinance reflects an attempt to reconcile local regulations with state mandates.

Councilmember Kristine D. Scott expressed concerns about the erosion of local control, a sentiment echoed by Mayor L. Dennis Michael, who lamented the limited authority of local officials in the face of state legislation. City Attorney Nick Ghirelli noted that by restricting the number of cannabis delivery businesses to one, the city could maintain some degree of regulatory control.

The city plans to impose strict zoning requirements on the permitted business, confining it to industrial areas away from schools, daycare centers, residential neighborhoods, places of worship, parks, public buildings, recreational areas, and hospitals. The proximity limits are set at a maximum of 600 feet from schools and daycare centers and 1,000 feet from other sensitive areas, as per state law specifications.

This decision has led to some debate about the adequacy of these distancing measures, with officials expressing a desire for more local discretion in determining appropriate separations. Deputy Director of Planning Jennifer Nakamura explained that the state law restricts the city's ability to increase these distances.

As a next step, the city intends to develop a lottery system to select the sole delivery service provider. This provider will operate a non-storefront business within the city, adhering to the newly established guidelines.
